Training Partnership Contract
This partnership contract is between myself, Nick Lynch and You.
I am excited to be entering into this partnership and contract with you. To be successful in this partnership, it is crucial that you and I establish a relationship based on honesty, integrity, and trust.
- Honesty means I promise to be here when you schedule a session, and you promise to show up early for your appointment. In our appointments, we tell the truth.
- Integrity means I am a man of my word and so are you.
- Trust is earned by being accountable in life and to this agreement.
Any quality and successful athlete, individual or organization incorporates these principles as part of their existence. You are making an investment in yourself. I am making an investment in you. And your financial provider is making an investment in you. It’s up to you to determine what the return on your investment will be.
Agreements
1) Training:
I agree to use my wisdom, knowledge, and 22 years of experience with training athletes, teams, corporate men and women, moms and dads and national and international organizations to develop and provide you with an ever-evolving plan to help you meet and exceed your goals.
2) Results:
Your results are defined by you.
They are based on your goals, abilities, commitment level and my recommendations for your success. In order for you to achieve your goals, it’s vital you stick to the plan and follow the guidelines set forth for you by me – Nick Lynch.
3) Hours of Service:
- Business hours: 9:00 am – 5:00 pm Monday through Thursday.
Business hours are when I am available to receive texts in reference to scheduling sessions. I am not available for business hours on Fridays, Saturdays, or Sundays.
- Training hours:
Monday – 9:00 am – 7:30 pm
Tuesday - 6:00 am - 6:30 pm
Wednesday - 6:00 am - 7:30 pm
Thursday - 7:00 am - 3:00pm
Friday – 6:00 am – 3:00 pm
Training hours are when I am with clients. Texts received during this time are reviewed when I’m available. This is why any schedule change must be received before Thursday @ 5:00 pm CST
4) Fees and Services at Superb Health and Performance:
I have created a fee schedule, which I personally manage and oversee to ensure your investment is successful. All fees at Superb Health and Performance are based on a unit system:
$1,040 = 40 units
$520 = 20 units
Units expire 1-year after purchase date
Coaching Services:
Personal training services one on one = 6 units per 1 hr. session
Partner training = 3 units per 1 hr. session
Client Services:
Client Services – Billed at 1 unit per 10-minute increment to assist you outside of our scheduled appointments, when you need help and advice.
Custom pricing - for groups, organizations or teams looking for personalized services.
Transfer of units to friends or family is allowed with 30 days notice.
Fees will increase annually based on the US Cost of Living % published in January to ensure I have what I need to continuously improve your experience at Superb Health and Performance.
I do not offer refunds.
Business Services:
I bill 1 unit per 10-minute increment to process declined payments or handling any concern in reference to your account.
1) Scheduling guidelines:
Send me your availability via text message for the upcoming week no later than 5:00 pm CT THURSDAY.
If you wish to lock in specific dates and times, we can work together to figure out a set schedule. This is preferred.
If either of us needs to cancel or change our scheduled time, we will give each other 24 business hours notice. This will likely happen for both of us on occasion. 24 hours notice for a Monday AM appointment is Thursday PM.
A cancelled appointment without 24 hours notice and for non-emergencies will be billed for that reserved time slot. In doing so, you value me and my time. You also acknowledge that by late canceling or not showing up for a scheduled appointment, you prevent another client from benefiting from that training time.
Emergencies can happen and are considered on occasion at no fee. Emergencies do not happen on a daily or weekly basis.
If either of us needs to make a change to this agreement, 30 days is required for this change to be implemented. You are financially responsible for being accountable to our agreement through the 30 days.
Whoever accepts financial responsibility for this agreement will also sign and agree to the guidelines of this agreement. If the person responsible for finances changes, the new person responsible will need to read and sign a new agreement.
Your signature acknowledges that these responsibilities and expectations were reviewed with you personally, that you understand them, and that you have been given the opportunity to ask questions.
